Non receipt of any order from the First Appellate Authority

The appellant sought various information about the cycle stand at the Unnav Railway station. The PIO provided point wise information against each of the queries. On appeal, the First Appellate Authority (FAA) did not respond to the appeal.

The Central Information Commission found that the First Appeal filed by the Applicant has not been adjudicated upon and no order from the Appellate Authority has been passed. Hence, the Commission remands the case back to the Appellate Authority in order that the AA may dispose of the matter expeditiously and judiciously on the above terms.
Comments
The different benches of the Commission have taken varying stands in such cases whether to decide them while passing a stricture against the FAA or send it back to the FAA for examination.
