1. Further to Commission’s order of even number dated 31 May 2013, matter pertaining to show cause notice was heard today. Both parties as above appeared in person and made submissions. Commission was informed that during the period January - May 2013, Shri A.K. Singh was CPIO and that as per the directions held in Commission’s aforementioned order of 31 May 2013, the CPIO was required to provide information by 21 June 2013.

2. Commissioner informed the current PIO is Shri J P Bansal. A copy of the previous order of the Commission is provided to the PIO with directions to provide information to the appellant within three weeks of receipt of the order. It is clarified by the appellant that the property in respect of which information is sought is the family property of the appellant.
3. For the harassment and detriment caused to the appellant due to the non– compliance of Commission’s order dated 31 May 2013 by the former CPIO, Shri A K Singh, Commission awards compensation of Rs. 5000/- to the appellant which about will be paid to him by the public authority within two weeks of receipt of the order. A copy of this order will be marked of the Chief engineer, Civil Lines Zone, North Delhi Municipal Corporation with recommendation as per the provisions of section 20(2) Where the Central Information Commission or the State Information Commission, as the case may be, at the time of deciding any complaint or appeal is of the opinion that the Central Public Information Officer or the State Public Information Officer, as the case may be, has, without any reasonable cause and persistently, failed to receive an application for information or has not furnished information within the time specified under sub-section (1) of section 7 or malafidely denied the request for information or knowingly given incorrect, incomplete or misleading information or destroyed information which was the subject of the request or obstructed in any manner in furnishing the information, it shall recommend for disciplinary action against the Central Public Information Officer or the State Public Information Officer, as the case may be, under the service rules applicable to him. of the Act to initiate disciplinary proceedings against the said officer for noncompliance of the directions of the Commission and thereby causing loss to the Corporation.
