Comment: I had taken Term Loan from the Regional Office of Maharashtra State Financial Corporation (MSFC), Kolhapur. Subsequently, State Bank of India, Wai Branch requested to create second charge on the property mortgaged with MSFC. The same was created.
In 2003 entire loan of MSFC was paid & Account with MSFC fully settled. The MSFC forwarded all original title deeds to SBI Wai except Lease Deed of which they sent a copy. This came to light very recently during the audit of the said bank.
Memorandum of entry clearly shows that original Lease Deed of M.I.D.C. was taken in possession by the M.S.F.C. The Annexure to the letter sent to bank under which the original Title Deeds were sent clearly mentions "Copy of Lease Deed" & the bank is holding a copy as said in the letter.
MSFC washed off their hands saying that they had forwarded all original documents to SBI Wai. Reply to RTI was also on the same lines. Now I will be applying to the next authority under RTI. May be, also under Consumer Protection Act & CrPC for illegal withholding of documents.
So, Keep Fighting till you get tired. This is the democratic process. We have an Act for remedy but still office holders have little regard for it.
