Information regarding property rented by a Public Authority

The appellant was the owner of one of the two adjacent flats rented to Punjab and Sind Bank. She wanted to know whether there was any difference in rent being paid to the two owners and if the case be so, why different rates were being paid in violation of principles of equity, uniformity and to follow the above principles being a government undertaking. She filed an RTI application seeking information about the size of the two flats and rent paid by the bank for this. The Public Information Officer (PIO) denied the information under section 8 (1) (d) of RTI Act, stating that the sought information is of commercial confidence in nature and would harm the competitive position of a third party. The First Appellate Authority (FAA) directed the PIO to provide information regarding the flat owned by the appellant, whereas, for the other flat the order of the PIO was upheld.

The Central Information Commission directed the PIO to provide the information about the sizes of the two flats 805 and 806 alongwith rents paid to the Appellant free of cost as per Section 7(6) of RTI Act.
