Information regarding appellant’s husband like his monthly & annual allowances including festival allowance, gross total salary, copy of joining report, copy of salary slip etc was sought - CIC: Provide the copy of latest pay slip severing the deductions

1. The appellant, Smt. Amanpreet Kaur, submitted RTI application dated February 18, 2014 before the Central Public Information Officer (CPIO), State Bank of India, Ludhiana; seeking information regarding her husband Shri Amardeep Singh’s monthly & annual allowances including festival allowance, details of gross total salary, copy of joining report at the said Branch, copy of salary slip etc., through a total of 4 points.
2. Vide reply dated March 8, 2014, the CPIO denied the information on point nos. A, C & D pertaining to Shri Amardeep Singh’s monthly & annual allowances including festival allowance, copy of joining report at the said Branch & copy of salary slip u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of the RTI Act, 2005 and informed on point B pertaining to gross total last drawn salary that it had already been furnished to her vide their letter dated 5.2.2014. Not satisfied with the CPIO’s reply, the appellant preferred an appeal dated March 24, 2014 to the first appellate authority (FAA) alleging that she had been provided unsatisfactory information by the CPIO concerned. Vide order dated 4 April 2014, the FAA directed the CPIO to provide the information, if available in the bank records severing the information exempted u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of the RTI Act, 2005 to the appellant at the earliest. In compliance of the FAA’s order; vide letter dated 10.4.2014, the CPIO furnished additional information to the appellant on all the points vide letter dated 10.4.2014.
3. Dissatisfied with the response of the public authority, the appellant preferred appeal before the Commission.
4. The matter was heard by the Commission. The appellant’s representative submitted that the appellant was his daughter and she was fighting a suit for maintenance from her husband Shri Amardeep Singh. She had seeking the information for the suit filed. He submitted that in point no.1 the respondents had not given the details of allowances like CCA, HRA etc., in response the respondent submitted that no allowance had been paid to Shri Amardeep Singh. On point 2, the appellant contended that detail of gross total salary was not given, only basic salary and DA had been given. On point 3, the appellant submitted that the copy of joining report at their Branch had been sought but only date of joining had been given; in response the respondent submitted that they did not maintain any joining report as such but maintained only the joining date. However, he offered to provide the copy of letter by which Branch informed their controlling authority about joining of Shri Amardeep Singh.

In view of the submissions made by both the parties, the Commission directs the respondent to furnish a copy of latest pay slip severing the deductions made, details of fixed allowances being paid and copy of the letter giving the date of joining at their Branch w.r.t. Shri Amardeep Singh to the appellant within one week of the receipt of the order of the Commission. The appeal is disposed of.
