Facts:
The appellant vide RTI application dated 02.02.2015 sought information on 16 points relating to the details of training programmes for different categories of Loco Pilots and Asstt. Loco Pilots who were ordered to attend TR-11 training course for the years 2011 to 2013 and other related information.
The CPIO vide his letter dated 04.03.2015 denied the sought for information u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. The appellant being aggrieved with the reply, filed first appeal on 02.04.2015 and submitted that the information sought by him are suo moto disclosable u/s 4(1)(b)(iii),(v),(ix) and 4(1)(c) Every public authority shall publish all relevant facts while formulating important policies or announcing the decisions which affect public; of the Act. The FAA also denied the information vide his order dated 06.05.2015. The relevant part of the order is extracted below:
“Out of 16 questions asked by you, with a lot of sub-questions under some questions, 8 questions (Sl No. 5,6,7,8,9,10,11 & 12) are purely clarificatory in nature. RTI Act do not provide for giving clarifications. From the balance 8(except 2 questions (Sl No 15 & 16)}, the information sought under 6 questions (Sl No. 1,2,3,4,5,13 & 14) are voluminous. The voluminous information asked by you is not readily available and collecting and compilation of the same would result in diversion of considerable resources and energy, which would affect the normal and regular duties of this administration. Moreover, the information sought by you pertains to third party and in no way related to transparency. Hence, no information can be furnished.”
The appellant being aggrieved filed second appeal before this Commission on 30.01.2016.

The respondent CPIO was absent despite valid and timely notice. He is to submit an explanation on the reason for not being present during the Commission’s hearing within a period of 10 days from the receipt of this order.
During the hearing, the appellant submitted that the information sought is about training programme attended by loco pilots and Asstt. Loco Pilots of various grades working in Shunting, goods etc. He received a reply from the respondent CPIO dated 04.03.2015 stating that information is voluminous and is exempted u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. The respondent was not present to defend the case.

Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of the RTI Act were wrongly claimed by the CPIO/PIO for denying the sought for information as the same was, by no stretch of imagination covered u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Moreover Sec 7(9) An information shall ordinarily be provided in the form in which it is sought unless it would disproportionately divert the resources of the public authority or would be detrimental to the safety or preservation of the record in question. An information shall ordinarily be provided in the form in which it is sought unless it would disproportionately divert the resources of the public authority or would be detrimental to the safety or preservation of the record in question. An information shall ordinarily be provided in the form in which it is sought unless it would disproportionately divert the resources of the public authority or would be detrimental to the safety or preservation of the record in question. An information shall ordinarily be provided in the form in which it is sought unless it would disproportionately divert the resources of the public authority or would be detrimental to the safety or preservation of the record in question. of the RTI Act is not an exemption clause i.e. it can not be quoted by any public authority for denying any information under the RTI Act. It was seen that the information sought for is eminently disclosable. A more comprehensive reply should have been provided to the appellant. The information sought does not appear to be voluminous.
Hence, the Commission is agreed with the appellant. The CPIO who was not present to defend the case on behalf of the public authority concerned is directed to provide point wise reply complete in all respects to the appellant as available on record including certified true copies of the documents sought for in the form of note sheet, letters, correspondence, e-mail etc free of charge u/s 7(6) of the RTI Act within 30 days of the receipt of the order.
The respondent CPIO is further directed to send a report containing the copy of the revised reply and the date of despatch of the same to the RTI appellant within 07 days thereafter to the Commission for record. The CPIO is reminded that continued non compliance of the CIC’s order may result in initiation of penal proceedings u/s 20 of the RTI Act against the CPIO.
With the above direction, the appeal is disposed of.
