Defence Ministry refuses information about TSD under section 8(1)(a)
21 Oct, 2013In a reply to an application filed under the Right to Information (RTI) Act seeking information about the Technical Support Division (TSD), the Defence Ministry has declined to provide information. TSD is an intelligence unit set up by former army chief VK Singh, and had been in news for allegedly supporting politicians of Kashmir. TSD has been accused of accused of illegally tapping phones of senior Defence Ministry officials and carrying out activities against the law.
The applicant had asked for a copy of the order and file notings regarding setting up of TSD. The application further sought the detail of complaints of irregularities received against the TSD. The Ministry of Defence (MoD) replied that the request for supply of order regarding setting up of 'TSD' and enquiry etc., cannot be supplied in terms of Section 8(1)(a) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, disclosure of which would prejudicially affect the sovereignty and integrity of India, the security, strategic, scientific or economic interests of the State, relation with foreign State or lead to incitement of an offence; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, disclosure of which would prejudicially affect the sovereignty and integrity of India, the security, strategic, scientific or economic interests of the State, relation with foreign State or lead to incitement of an offence; of the RTI Act.
