CVC had recommended penalty against the members of the Selection Committee

Comment: The Ministry vide their detailed letter dated 19.02.2015 had further justified denial of information to the appellant before the CIC that “The officers and members of the staff who make such noting perform the thankless task of commenting on the conduct, reputation, behaviour of the officers enquired into apart from analysing the evidence in order to help the
competent authority make an informed decision. Such comments and remarks recorded by officers, if disclosed to the very person against whom these are recorded, have the potentiality of being used by the employee to start legal processes against these officers for charges such as defamation, criminal conspiracy and so on.”
The NHAI had recruited 87 DGM (T) in 2010 on urgent direction of the then RTH Minister. The CVC had recommended major penalty against the junior officers who were not members of Selection Committee or Screening Committee and minor penalty against all the senior officers, who were Committee members. The relevant information through RTI would reveal the circumstances leading to such bizarre recommendation of CVC and decision thereof.
