The appellant filed an RTI application on 30.03.2013, seeking information regarding slides / blocks while operation of his wife, for seeking second opinion. PIO/Sr. Admn. Officer in his reply informed the appellant that for obtaining the slides/blocks, the appellant will have to apply before the Head, Dept. of Pathology. FAA/Dir. upheld the CPIO’s decision. The appellant stated that his wife is suffering from Cancer and that he wanted the information in order to obtain second opinion from other doctors. The respondent stated that the appellant was informed that he can apply to the Head of Pathology Dept. to obtain the slides/blocks. The appellant contended that the RTI application should have been transferred to the Pathology Dept. The respondent stated that the procedure to obtain slides/blocks relating to medical specimens, having medico-legal significance, is already laid down in hospitals and that the appellant was informed regarding the same.

The appellant filed an RTI application on 19.03.2013, seeking information regarding doctors involved in his wife’s operation, grade of surgery charges, major OT charges, Doctor’s fee charges, etc. PIO/Sr. Admn. Officer provided point-wise information to the appellant. FAA/Dir. in his order recorded that the appellant is satisfied with information provided by PIO on Points 1, 2, 4 & 6, but not on Points 1, 3 & 5. The FAA clarified the information on the said points and disposed of the first appeal filed by the appellant. The appellant stated that he is satisfied with the information provided and that he does not wish to press the matter any further.

The appellant filed an RTI application on 20.03.2013, seeking information regarding the criteria to obtain original record from the Hospital, categories entitled to get free cancer operation and medical treatment, etc. PIO/Sr. Admn. Officer provided point-wise reply to the appellant. The FAA/Dir. upheld PIO’s decision. The respondent stated that the information sought by the appellant is easily accessible on the website of the respondent authority. He stated that every patient is given a Pin no. and the medical records can be accessed online, by using the personal Pin of each patient. The respondent urged that the appellant need not go through the RTI route in order to obtain such record as the same is easily accessible to the patient, even otherwise.
Decision:
After hearing both the parties and on perusal of record, the Commission, in F.No.CIC/LS/A/2013/001363-YA, finds that the appellant was already informed about the said procedure for obtaining slides/blocks; however, the appellant chose to take the RTI Route. The Commission does not find any discrepancy in the CPIO’s reply. The same is upheld.
In F.No.CIC/LS/A/2013/001369-YA, information has been provided to the satisfaction of the appellant and no further action is required.
In F.No.CIC/LS/A/2013/001386-YA, the Commission is of the view that information has been provided to the appellant and no further action is required. The appeals are disposed of accordingly.
