Copies of the orders of revival of enquiry against 5 persons & their exoneration were sought - PIO: enquiry was conducted by the Dept of Home, whatever information was available has been provided - CIC: furnish the complete information
2 Mar, 2014ORDER
FACTS
1. During the hearing, the appellant submitted that he specifically wanted to have the information regarding the details of dropping of charges against 5 officers and their exoneration, who were supposed to be properly exonerated by the Home Secretary of Delhi Govt., being the appellate authority in their case, as mentioned in his point (A) of his RTI application. But the information provided by the respondent is with reference to the charge sheet 1024, which relate to the appellant’s own case. The appellant is actually seeking information about the charge sheets 1023, 1025, 1027 and 1028 pertaining to revival of enquiry and exoneration of the 5 officers. The claim of the respondent that he has furnished the relevant information to the appellant appears to be not correct. The respondent submitted that the enquiry was conducted against the officers belonging to Delhi Fire Service by the Department of Home of the NCT, Delhi. Therefore, they do not have any information other than what they have communicated to the appellant.
2. In brief, what the appellant wants are the copies of the orders of revival of enquiry against the 5 persons, copies of their exoneration by the Appellate Authority (Home Secretary, Govt. of Delhi in this case). The appellant is also seeking copies of the appeal made by the 5 persons to the Appellate Authority.
3. The respondent is directed to furnish the information within one month as agreed by him from the date of receipt of this order.
