24 Apr, 2017FACTS:
1. The Commission filed RTI application seeking to know whether gratuity Act 1972 is applicable to teachers who retired after 25.05.2010, amendment to the Act etc. The CPIO transferred the application to CPIO Preliminary Education Department, UP Secretariat, Lucknow and to MHRD which was further transferred to NCTE. The complainant approached the Commission.
Decision:
2. The complainant stated that the information sought was not provided and his RTI application was transferred to several CPIOs who did not revert in a positive way. The CPIO stated that Gratuity Act, 1972 does applies to teachers retired after 2010 and still the erstwhile CPIO transferred the RTI application of this complainant without application of his mind.
3. Having heard both the parties and going through the records available, the Commission advises the public authority to desist from these kinds of practices which defeats the very purpose and motive of the RTI Act, 2005. Further, the CPIO agreed to send all the relevant information to the complainant within 15 days from the date of receipt of this Order. With the above directions, the complaint is disposed of.
