During the hearing the appellant submitted that no reply was provided to him. The respondent CPIO submitted that after the receipt of the CIC notice, final reply including all the documents/annexures sought for in the said RTI application were provided to the appellant on 08.03.2017.
A warning is issued to the then respondent CPIO and the Chairman, RRC, Delhi to be more careful in regard to the statutory time limit, while replying to RTI applications in future. The registry of this bench is directed to send a copy of this order to the above two officials.
On perusal of the case record, it was seen that reply provided was just and proper but late. Since the appellant did not receive the same, the respondent CPIO is directed to resend the reply, to the appellant, within 3 days of the receipt of the order. A compliance report with proof of despatch of the said reply to the appellant shall be submitted within 07 days thereafter to the Commission for record. With the above direction, the appeal is disposed of.
