Information sought:
The appellant had sought copy of all promotion orders for Loco Pilot (Goods) issued at Chennai Division after 01.01.2011, copy of promotion order dated 07.10.2011, copy of seniority list of the Loco Pilot from 2008 to 2014 with details, official email id & other details of FAA (First Appellate Authority under the RTI Act) and other related information.

During the course of hearing, the appellant submitted as follows :
1. That the information sought by him is suo motu disclosable by the public authority under Section 4(1)(b) Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; (ii) the powers and duties of its officers and employees; (iii) the procedure followed in the decision making process, including channels of supervision and accountability; (iv) the norms set by it for the discharge of its functions; (v) the rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions; (vi) a statement of the categories of documents that are held by it or under its control; (vii) the particulars of any arrangement that exists for consultation with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof; (viii) a statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public; (ix) a directory of its officers and employees; (x) the monthly remuneration received by each of its officers and employees, including the system of compensation as provided in its regulations; (xi) the budget allocated to each of its agency, indicating the particulars of all plans, proposed expenditures and reports on disbursements made; (xii) the manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes; (xiii) particulars of recipients of concessions, permits or authorisations granted by it; (xiv) details in respect of the information, available to or held by it, reduced in an electronic form; (xv) the particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use; (xvi) the names, designations and other particulars of the Public Information Officers; (xvii) such other information as may be prescribed and thereafter update these publications every year; Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; (ii) the powers and duties of its officers and employees; (iii) the procedure followed in the decision making process, including channels of supervision and accountability; (iv) the norms set by it for the discharge of its functions; (v) the rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions; (vi) a statement of the categories of documents that are held by it or under its control; (vii) the particulars of any arrangement that exists for consultation with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof; (viii) a statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public; (ix) a directory of its officers and employees; (x) the monthly remuneration received by each of its officers and employees, including the system of compensation as provided in its regulations; (xi) the budget allocated to each of its agency, indicating the particulars of all plans, proposed expenditures and reports on disbursements made; (xii) the manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes; (xiii) particulars of recipients of concessions, permits or authorisations granted by it; (xiv) details in respect of the information, available to or held by it, reduced in an electronic form; (xv) the particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use; (xvi) the names, designations and other particulars of the Public Information Officers; (xvii) such other information as may be prescribed and thereafter update these publications every year; of the RTI Act.
2. Under Sections 4(2) It shall be a constant endeavour of every public authority to take steps in accordance with the requirements of clause (b) of sub-section (1) to provide as much information suo motu to the public at regular intervals through various means of communications, including internet, so that the public have minimum resort to the use of this Act to obtain information. & 4(3) For the purposes of sub-section (1), every information shall be disseminated widely and in such form and manner which is easily accessible to the public. of the RTI Act, public authority has to declare such information in a suo moto manner on its website.
3. Under Section 4(1) (a) of the RTI Act, the Public Authority should have duly categorised such information properly before putting it up on its website for information of general public.

He further stressed on the proviso to Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of the RTI Act which provides that information which cannot be denied to parliament cannot be denied to anybody.
5. He stated that the information sought is directly related to the safety of the travelling public, hence, promotion of loco pilot or their advancement in career should be transparent so that the safety of the travelling public is not compromised.
6. 7. He also contended that the clarification sought is not clarification, actually he wants any material e.g. opinion or advice in regard to the promotion of loco pilot as available on record. 8. In regard to claim of CPIO that voluminous information was sought he relied on the Supreme Court judgement in the case of CBSE vs Aditya Bandopadhyay as a benchmark for defining what is termed as “voluminous information”.

He also stated that CPIO did not read the RTI question properly.
On point 17, he simply wanted the e-mail of the CPIO.
As regards Point no. 3 of the said RTI application, the sought for information was not provided but it could have been provided easily. This gives an impression that cyclostyled reply was provided to the applicant without the CPIO duly applying his mind before such reply was provided to the appellant.

In respect of paras 3 to 6, the Commission examined the sought for information and found that information relating to the date of birth is personal information. It is relevant to quote the decision of the Hon’ble Delhi High Court in its decision dated 31/10/2013 ( WP (C) No. 677/2013 & CM no. 1293 of 2013 Union of India V/S Anita Singh) wherein it was held as under:-
“4. The passport of Mr. Ajeet Singh would have his personal information such as the address, date of birth and the name of his parents. The information such as date of birth and residential address of the passport holder would constitute personal information within the meaning of Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Since neither the respondent sought disclosure of the said documents in special circumstances such as existence of any public interest nor the Commission recording finding that the larger public interest required disclosure of the said information to him, the said information would be exempt from disclosure under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. As far as the above para is concerned, the information sought is specific in nature, there is no justifiable ground to withhold the sought for information.

3. ‘A’ an employee of your Bangalore division promoted in the year 2008 as Loco Pilot (shunting) Gr.II. ‘B’ an employee of your Chennai Division promoted in the year 2002 as Loco Pilot (Shunting) Gr.II If ‘A’ got mutual transfer with ‘B’ in the year 2011, whether the seniority for’A’ will be fixed at your Chennai Division in the cadre of Loco Pilot (shunting) Gr.II from the year 2002 OR 2008.
4. In Letter No. M/P (1E) 535/VI/RG/LP Goods II dated 19.02.2013 issued from Dovl. Rly Manager’s office, Personnel Branch, MAS Division, Chennai-3, Para 8 it is stated as follows
8. The employees who are promoted will maintain their seniority as per the panel. Also they will not claim any seniority over the seniors who are in the panel. Also they will not claim any seniority over the seniors who are in the panel and will be promoted later on completion of Tr-11 training. Based on the above, If ‘A’ an employee of your Division promoted on 26.03.2010 as Loco Pilot (Shunting) Gr.II and promoted as Loco Pilot (Goods) on 07.10.2011 and; ‘B’ an employee of Bangalore division transferred to Chennai Division as Loco Pilot (shunting) Gr.II and got seniority from 18.03.2008 as per existing rules & seniority list published on 01.05.2011. Subsequently ‘B’ promoted as Loco Pilot ( Goods) on 19.02.2013 Then kindly furnish the information based on procedure involved, whether B will be senior over to A in the Seniority List of Loco Pilot (Goods).

Decision:
The appellant had sought huge information, which is of two categories. The Commission finds it appropriate to direct the CPIO to provide parawise information as discussed parawise in the above paras. It is relevant to rely on the decision of Hon’ble Bombay High Court in the matter of Dr. Celsa Pinto, Ex-Officio Joint ... vs The Goa State Information............, decision dated 3 April, 2008. The Public Information Authorities cannot expect to communicate to the citizen the reason why a certain thing was done or not done in the sense of a justification because the citizen makes a requisition about information. Justifications are matter within the domain of adjudicating authorities and cannot properly be classified as information.”
In the light of the above decision, the CPIO is hereby directed to provide parawise information in the form of certified copies, as available on record in respect of the paras which are specifically mentioned above, within 21 days from the date of receipt of this order. With the above direction, the appeal is disposed of.
