CBDT directed to disclose information related to chargesheet quashed by CAT
20 Feb, 2013An application was filed with the Central Board of Direct Taxes (CBDT) under the Right to Information (RTI) Act seeking to know the number of charge sheets against officers of Indian Revenue Services (IRS) quashed by the Central Administrative Tribunal (CAT) on the basis that they were not signed by the Finance Minister.
CBDT, the cadre controlling authority of the IRS, declined to provide the information stating that said that requisite information was not part of records. Information regarding the number of such decisions challenged in the courts and the number of suspensions/dismissals revoked on the basis of CAT orders was also refused.
The applicant then approached the Central Information Commission (CIC). The CIC has now directed the CBDT to disclose the sought information within three weeks and to forward the application to the concerned PIOs for information which is not with the CBDT (Vigilance).
