Sealing of an Illegal tube-well under RTI

Background
The Appellant sought information regarding illegal tube well which was being operated by an individual in violation of the environmental norms. The individual was selling water from this tube well illegally and it was claimed that some unruly elements hang around the tube well who were harassing the women and children in that area.

During hearing, the respondents (DJB) submitted that they are aware of illegal tube well being operated in the area and action is being taken to seal that illegal tube well sealed. The appellant stated that he is not keen on receiving any information and all that he wants is the illegal tube-well to be sealed. After hearing the submissions by both sides and keeping public interest in mind, the Commission recommended very strongly that the Deputy Commissioner (Revenue)/South take this matter up on an urgent basis and ensure that the tube well is sealed. Information about action taken may be provided to the Appellant and to the Commission.
Comments
Though the RTI Act is only about obtaining information, with a little ingenuity, many applicants have used it to obtain directions for enforcing the law.
