Doubts about the authenticity of the data provided by the PIO
10 Jan, 2012
Background of the case
The appellant sought yearwise and statewise information about the number of persons who are infected with HIV, deaths due to HIV, etc. along with other information about the prevalence of HIV in homosexuals and prostitutes. The PIO provided most of the information to the appellant with which the appellant was not satisfied. On appeal, the FAA endorsed the decision of the PIO.
View of CIC
During the hearing, the appellant claimed that the PIO has provided false and incomplete information. The respondent stated that information has been provided as per available records. The Commission noted that the appellant appears to doubt the veracity some of the data provided by the PIO. The Commission rejected the appeal holding that the information available on the records appears to have been provided.
