Can any additional information be provided at the appeal level?

The applicant sought information related to pictorial warnings on tobacco-products and the directions given by the Union Health Ministry regarding the area to be covered by pictorial warnings on wholesale packs of tobacco-products. The appellant also asked the details of any exemptions given by the Union Health Ministry in the matter. The appellant was dissatisfied with the reply of the PIO in the matter of the directions given by the Union Health Ministry regarding the area to be covered by pictorial warnings on wholesale packs of tobacco-products stating that the supporting documents have not been provided to him.
View of the CIC
During the hearing, the Commission found that the relevant information has been already given to the appellant and that no supportive documents were sought by the appellant in the original application. The CIC upheld the decision of the PIO.
Comments
The first appeal can be filed against the order of the PIO and second appeal against the order of the First Appellate Authority. No additional information can be sought at any of the two appeal levels.
