Can information regarding service benefits be termed as third party information?

The appellant sought information regarding educational allowance that was given to a government servant including copies of certificate, fee receipts, hostel fee etc.. The PIO replied that the information belonged to third party who has objected to disclosure of the information. The Appellate Authority endorsed the decision of the PIO.

The Commission held that information relates to the service benefits being enjoyed by the employee as a result of his working in the Railways and cannot be considered as third party information. The Commission directed to provide complete information to the Appellant.
