BMRCL imposes ban on disclosure of minutes of board meetings
8 Jun, 2013The Bangalore Metro Rail Corporation Limited (BMRCL) has decided not to disclose the minutes of board meetings and other important committee meetings claiming exemption under section 8(1)(a) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, disclosure of which would prejudicially affect the sovereignty and integrity of India, the security, strategic, scientific or economic interests of the State, relation with foreign State or lead to incitement of an offence; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, disclosure of which would prejudicially affect the sovereignty and integrity of India, the security, strategic, scientific or economic interests of the State, relation with foreign State or lead to incitement of an offence; and section 8(1)(d) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information; of the Right to Information (RTI) Act.

BMRCL had claimed that disclosure of the drawings and sketches of civil constructions and Metro stations may pose threat to its security.
As a result of this decision, various issues like Metro alignment etc. wil now are beyond the reach of the citizens.
In past also the BMRCL had refused similar information claiming exemption under section 8(1)(d) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information; . The Karnataka Information Commission had not accepted this plea and had ordered for disclosure of information. The PIO of the BMRCL had been penalised twice in the past, once with a fine of Rs 25,000/- for a delay of 11 months in providing the information and second time with Rs 5,000/- for failing to provide satisfactory information about its procurement of sand.
