Bill should be passed to finalize complaints against the Chartered Accountants within stipulated time
Ref: Names of members of ICAI against whom complaints are pending cannot be disclosed u/s 8(1)(j)
Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information:
Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person.
- no time limit prescribed for disposal of complaints under the CA Act, 1949 - the number of pending cases and stage at which they are pending to be disclosed
Government of India has to pass the bill to finalize the complaints within stipulated time limit as comments passed by the President of India that “delay in judiciary is injustice to the people. To save from injustice case should not be prolonged & it should be banned. People are fitting the case by selling their property, ornaments etc to obtained justice."
This is the only institute who is handling cases against their notified CAs so there must be time limit otherwise purpose will not be fulfilled. Prime minister had in his speech also advised the president of CA institute to ensure the correct measure to save India. I think advice is not enough, concrete amendment is required at once.
