Appellant submitted that they were not aware about the existence of their names in the electoral rolls - CIC: the CEO to provide the status report about the appellant’s application for voter ID card & reasons why FIR is filed against the appellant
6 Nov, 2014FACTS
2. The appellant submitted that through her RTI application dated 13.4.2013, she has sought information regarding her application dated 28.1.2013 for issue of Voter ID Cards to her and her husband. The PIO has given the reply by his letter dated 30.5.2013. Not satisfied, the appellant made first appeal before the FAA. The FAA’s order is not available on the file. Claiming that the respondent authority has not furnished complete information, the appellant has filed 2nd appeal before the Commission.
Decision:
3. Heard the submissions made by both the parties. While the appellant alleged that the earlier PIO threatened him with criminal case, if he does not pay certain amount of money, the present PIO stated that he has taken over only three months back and he finds in this case that an FIR is lodged against the appellant for giving wrong information that their names were not existing in the electoral rolls of any other Assembly Constituency, which was false. The appellant submitted that they stayed for 7 years in Sagarpur Assembly constituency and they were not aware about the existence of their names in the said electoral rolls. It appears to the Commission that there is something seriously wrong in the present case and hence the Commission directs the respondent authority to provide status report to the Commission about the appellant’s application for voter ID card and the reasons why FIR is filed against the appellant, with a copy to the appellant also, within 15 days from the date of receipt of this order.
4. The appeal is disposed of accordingly.
