1. Shri Narendra Kumar Roy, the appellant sought copy of TR or names of the students, fathers’ names, roll no., roll code, year, date of birth, subject wise marks and category of the Roll no. 5109062 (year 2009), 7157408 (year 2011), 7130973 (year 2011) and 712234 (year 2011).
2. The CPIO intimated the appellant that the information sought was personal information of the students and denied the same u/s 8(1)(g) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, the disclosure of which would endanger the life or physical safety of any person or identify the source of information or assistance given in confidence for law enforcement or security purposes; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, the disclosure of which would endanger the life or physical safety of any person or identify the source of information or assistance given in confidence for law enforcement or security purposes; of the RTI Act due to security and safety aspect of the students. Dissatisfied, the appellant approached the FAA. The FAA while upholding the CPIO’s reply observed that Roll no. 5109062 was not related to Regional Office Patna and the rest was third party information. Not quite satisfied, the appellant came in second appeal before the Commission.
3. The matter was heard by the Commission. The appellant was not present in spite of notice of hearing having been sent to him.

The respondent stated that the RTI application was filed by the appellant online on 16.09.2016 and the reply had been provided to him on 04.10.2016 denying the information u/s 8(1)(g) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, the disclosure of which would endanger the life or physical safety of any person or identify the source of information or assistance given in confidence for law enforcement or security purposes; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, the disclosure of which would endanger the life or physical safety of any person or identify the source of information or assistance given in confidence for law enforcement or security purposes; of the RTI Act. The CPIO stated that the information sought was personal information of third party and the disclosure of the same to the appellant involved the security and safety aspect of the students, moreover, the same would also lead to invasion of the privacy of the individual. The appellant was not present to put forth his contentions, if any.

The Commission observes that the appellant sought names of the students, fathers’ names, roll no., roll code, year, date of birth, subject wise marks and category of four roll nos. mentioned in the RTI application and which is clearly personal information of third party. Moreover, no larger public interest is involved in the matter. The Commission, therefore, accepts the respondent’s submissions in the matter. The appeal is disposed of.
