The appellant through his RTI dated 17.10.2013 sought information related to the chronological progress of the representations made by him to the assistant registrar with regard to irregularities which come into light after Audited Account were supplied under direction of registrar Corporative Societies Office under section 139 of the Delhi Cooperative Society Act 2003; present status of his representations; reasons for delay of about 10 months and 7 other points. The PIO replied on 14.11.2013 giving point wise answers in which point no.1 was answered by saying that his representation were received, point no. 2,4,5,6,8 & 9 that the information is not covered under section 2(f) “information” means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force; of the RTI Act. Unsatisfied with the PIO’s reply, the appellant filed his first appeal on 16.12.2013. The FAA through his ordered dated 21.1.14 directs the Assistant Registrar to put up the representations immediately within a week’s time and also get the matter processed. Thereafter appellant has filed a second appeal before the commission on 26.03.2014 with a prayed to know the reasons for the delay in the processing of his representations, reasons for non compliance of the FAA’s orders and also for the list of persons responsible for such inaction.
3. During the hearing, the Appellant submitted that several people of the society have not paid the fee but was shown as paid in the ledger and he has made a complaint in the month of Jan.2013. On not receiving any reply, he filed an RTI application on 17.10.13. On not receiving any reply, he filed another RTI application on 9.5.14 and third RTI application on 15.10.14 and no reply has been received.
4. The Commission directs the PIO to provide a comprehensive reply for all the three RTI applications to the Appellant within three weeks including whether the money has been received and if so, whether it was deposited and when deposited in the bank.
5, The appeal is disposed with the above direction.
