The appellant wants to know the details of Smt. Mamatha Bai. V w/o Sh. S Viswanath Rao (SB A/c No. 3164528 opened at Vijayanagar East PO, Bangalore - 40)
1. Date of opening & Name of the nominee of SB A/c No. 3164528.
2. Details of Encashment of Rs. 3000 received from Govt of Karnataka (i.e. Cheque No. & date).
Grounds for the Second Appeal: The CPIO has denied the information under Section 8(1)(e) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; of the RTI Act.

The CPIO’s representative stated that the information sought by the appellant relates to a depositor and cannot be disclosed to third party including relatives being exempt under Section 8(1)(e) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; of the RTI Act. The appellant pleaded that he has introduced the account and without his introduction the account could never have been opened and atleast the date of opening of the account and details of encashment of cheque for Rs.3000/- should be supplied. The CPIO’s representative agreed.

As agreed by the CPIO’s representative the information as above should be supplied to the appellant within a week. The appeal is disposed of accordingly.
