The Appellant sought certified copies of documents related to action taken by Principal Accounts office, MoI & B on order no. 25/2014 – AR dated 06.05.2014 in File No. 7/13/2008 – AR/258 regarding in situ promotions effected in the department.
Grounds for the Second Appeal:
The CPIO has not provided the desired information.
Relevant Facts emerging during Hearing:
The following were present:-
Appellant: Present through VC.
Respondent: Umesh Kumar Saxena, Sr. Accounts Officer & CPIO, (Pay & Accounts Office), CGO Complex, New Delhi present in person.
Appellant stated that despite FAA’s order he has not received any reply from the CPIO. CPIO submitted that on 04.08.2016, the Appellant was asked to provide his IRLA number for provisioning desired information to the Appellant. He further submitted that after receiving notice of hearing from Commission, it dawned upon him that the earlier reply of 04.08.2016 was erroneous. Accordingly, final reply dated 11.01.2018 was sent to the Appellant.
Decision
Commission expresses serious displeasure over the conduct of then CPIO in not applying mind properly and warns him to be careful in future while dealing with matters under RTI Act. CPIO is directed to resend his reply dated 11.01.2018 alongwith enclosures to the Appellant by speed/registered post within 15 days of receipt of this order.
The appeal is disposed of accordingly.
